Short answer: In Nova Scotia, the minimum wage is $17.00 an hour from 1 October 2026. There is no lower wage for tipped staff: tips come on top of the full minimum wage. Today the Labour Standards Code does not protect tips, and the government guide says pay does not include tips and gratuities.

Second step of 2026. The rate rose from 16.50 to 16.75 on 1 April 2026, then to 17.00 on 1 October 2026. Adjustments follow the consumer price index plus 1%.

No lower wage for tipped staff. Tips are not pay under the Labour Standards Code.

Upcoming changes

No rate is announced after 1 October 2026. Separately, new tip rules (Bill 256) start 1 April 2027.

Who owns the tips

Today the Labour Standards Code does not protect tips, and the government guide says pay does not include tips and gratuities. That changes on 1 April 2027: Bill 256 received Royal Assent on 18 September 2026 and the government says it will ensure tips and gratuities go to the people who earn them.

Tip pools

Until 1 April 2027 the Labour Standards Code has no tip pooling rules, so pools are up to the employer. Bill 256 (passed September 2026) adds tip protections from 1 April 2027, but the government has not published details on pooling in the sources we could open.

Can card fees come out of tips?

No rule at the moment. Bill 256 is meant to make sure tips go to the people who earn them from 1 April 2027, but we could not confirm whether it addresses card fees.

Income tax on tips in Nova Scotia

Tips are taxable income. The CRA says you must report all tips: direct tips go on your return and controlled tips (paid through your employer) should already be on your T4. We found no exemption or deduction for tips in federal or Nova Scotia tax rules.

Other rules

  • Bill 256 also lowers the weekly overtime threshold from 48 to 44 hours from 1 April 2027.

The agency in charge is the Nova Scotia Labour Standards (Labour, Skills and Immigration).

Sharing tips fairly
